Honolulu: Kahala Leasehold Condo Owners Sue City

The leasehold owners of 4999 Kahala Ave (Kahala Beach Apartments) have filed suit against the city in anticipation of tomorrows Honolulu City Council vote to overturn the controversial leasehold conversion law.

The owners who are currently going through the city’s process to condemn the land under the condo in order to sell the fee simple interest to them have sued the city for breach of contract. The law, called Chapter 38, originally came into effect in 1991, allows for the city to acquire land by eminent domain in order to sell it to leasehold condo owners under certain conditions. The current city council is expected to vote to overturn the law tomorrow.

On January 13, 2005, Charles Djou, the councilman for Waikiki, made a proposal to amend the new law to allow for condominium owners going through the process currently, to be allowed to continue the process. He said not allowing these leasehold owners to continue would expose the city to numerous lawsuits. The committee rejected this proposal.

The suit asks for the city to comply with the current contracts and asks for unspecified damages
